Cannabis and the law in 2026: An overview of the rules for legal cultivation ????
On January 1, 2026, a fundamental amendment to the Criminal Code came into effect in the Czech Republic. This legislation provides clear rules for personal cannabis cultivation and possession, strictly distinguishing between legal use, misdemeanors, and criminal offenses.
Who can legally grow and possess cannabis? ????
The possibility of legally growing cannabis (with a THC content of more than 1%) for personal use is limited exclusively to persons over the age of 21. Plants may only be kept on one's own property, in a rented property, or in premises to which the person has another legal relationship.
Personal cultivation of cannabis – permitted limits ????
Caution: When growing outdoors, there is a risk that the plants will exceed the legal limit. We recommend choosing suitable methods or autoflowering varieties.

Distribution and sale of cannabis in the Czech Republic ????
Even after the amendment to the law, any sale or distribution of cannabis to third parties in the Czech Republic remains prohibited. Transferring cannabis (even free of charge) is classified as a criminal offense under § 283a.
Purchasing cannabis seeds in 2026????
The good news is that cannabis seeds are not considered an addictive substance. Their purchase, sale, and possession are completely legal. From a legal standpoint, only a germinated plant with a THC content of over 1% is considered cannabis.
